Direct and Indirect Representation

INDIRECT Representation

Indirect Representation is undertaken when the Customs broker submits customs declarations for a non-UK organisation that is the import in the UK. This usually happens when the Incoterms are DDP.

The Indirect Representation allows the Customs broker to act in their own name, on behalf of the importer and both the importer and the customs broker can be responsible for any debt owed to HMRC.

If you are interested in appointing a Customs Broker on a Indirect Representation, a contract to undermine the Letter of Empowerment should be considered

Unless your business is submitting the customs declarations in-house, which is known as self-declaration, you could appoint a Customs Broker to submit customs declarations on your behalf to HM Revenue and Customs (HMRC).

A Customs Broker is able to represent your business in two forms: DIRECT and INDIRECT.

DIRECT Representation

Direct Representation is undertaken when the Customs broker acts on behalf and in the name of the Importer. As the importer of record, you are responsible to provide accurate instructions for the customs declaration. This means that you are also responsible for any debt that may arise to HMRC.

Appointing a Customs Broker as a Direct Representative can be done by completing a simple declaration by yourself.
